Oatly Agrees to $9.25M Settlement Over Allegations of Overstated Environmental Claims

Swedish oat drink company Oatly has agreed to a $9.25 million settlement following allegations of greenwashing. The lawsuit, initiated by investor Kai Jochims in July 2021, claimed that Oatly’s promotional strategies had led to “artificial” inflation of its share prices by overstating product demand and environmental credentials. This settlement comes after a mediation session held in October, although it is still awaiting final court approval. The lawsuit against Oatly surfaced shortly after the company’s successful $1.4 billion initial public offering (IPO), when the trading price of the company’s US shares dipped approximately 9%. This decline was attributed to accusations from a short-seller, labeling Oatly’s environmental claims as misleading. The consolidated lawsuit encompassed various investor complaints, centralizing around allegations of financial misrepresentation and exaggerated environmental sustainability …

Oatly Wins Major Legal Milestone: High Court Validates Use of ‘Milk’ Terminology

The plant-based industry witnessed a significant legal milestone as Swedish vegan food giant Oatly has emerged victorious in a four-year legal battle with Dairy UK Ltd. The High Court’s decision, led by Mr. Justice Richard Smith, allows Oatly to use the word ‘milk’ on its product packaging as part of its slogan ‘Post Milk Generation.’ This case pivots on the 2013 European Court regulations, which Dairy UK cited to challenge Oatly’s use of ‘milk’ for non-animal-based products. Judge Smith, however, emphasized the unlikely risk of consumer deception, noting that Oatly’s slogan does not suggest its products are dairy-based. He states, “The mark was not being used to define, designate, describe or name any food, foodstuff or food product, as opposed to describing its source,” as …

Oatly, Alpro, DUG, Planti, and More Urge Swedish Government to Push for Plant-Based Milk in EU School Scheme Review

Oatly, Alpro (Danone), DUG (Veg of Lund), Planti, Oddlygood, and Sproud, under the umbrella of Plant-based Sweden (Växtbaserat Sverige), have sent a letter to the Swedish government urging it to advocate for the inclusion of plant-based milk in the upcoming review of the EU School Scheme. Currently, the EU School Scheme aids over 20 million European children by providing them with milk, fruit, and vegetables. However, it does not encompass milk alternatives, even though numerous children are unable or unwilling to consume dairy due to medical, ethical, taste, or environmental concerns. Last year, ProVeg and The Vegan Society collected tens of thousands of signatures calling for the EU to add plant-based milk to the scheme. The Green REV Institute also issued an open letter calling for plant milk in schools, arguing that …

Oatly’s Call for Big Dairy Execs to Join Climate Labelling Debate Receives Just One Response

As part of its campaign calling for climate labelling on all food and drink products in the UK, Oatly recently hosted a debate where it invited a “Big Dairy Executive” to explain their stance on the subject. Despite the spot being open to dairy executives from across the EU, and the 26 million views received by Oatly’s campaign launch video on social media, the company received just one response from the dairy industry — and it wasn’t from an executive. Bryce Cunningham is a farmer from Mossgiel Organic Farm in Ayrshire, Scotland, who told the Daily Record that he “felt that Oatly’s claims were unjustified”. Mossgiel is working to reduce its carbon emissions, with the aim of reaching net zero by December 2025. The farm …

Oatly Calls for Climate Labelling in the UK, Challenges “Big Dairy” to Publish Its Climate Impact

The company, which already makes its emissions data public, has published a paper titled Climate Labelling: Why Not? to make the case for others to follow suit. The report has been dubbed a “grey paper”, in recognition of the fact that “climate labelling isn’t a black and white issue where certain foods are good and others are not”. Oatly hopes to join forces with other companies to come up with an effective climate labelling system and put pressure on the UK government to make it mandatory. To promote the campaign, Oatly is offering free high-profile ad spots to the dairy industry if it makes its climate …
